We're I to copy the pattern precisely, a copyright would apply. A copyright on a picture simply means I cannot use the picture itself for commercial purposes. There's no law against creating one's own pattern based upon another's design. The trademark goes to logo and name usage. That, I would never copy

I am interested in getting a pattern made from a paper template that I've been using. Can I send you a photo of the paper template with some measurements? It's a very simple one-piece shape but it has some curves and I'm no good with Illustrator.
